These Terms and Conditions (“Terms”) govern your use of the website miga-atl.com (the “Site”) and the purchase of products and services offered by MIGA (“we,” “us,” or “our”), an artisan cottage bakery operating in Atlanta, Georgia.
By accessing our Site, placing an order, or subscribing to any of our services, you agree to be bound by these Terms. If you do not agree, please do not use our Site or purchase our products.
MIGA is a cottage food business registered with the Georgia Department of Agriculture (GDA Identification Number 6278354) and operates in compliance with Georgia HB 398 (effective July 1, 2025).
All products sold by MIGA are produced in a residential kitchen that is exempt from state food safety inspection by the Georgia Department of Agriculture. Products may contain allergens.
This disclosure is required by Georgia law and is also printed on all product labels. By purchasing from MIGA, you acknowledge and accept this.
We make every effort to describe and display our products accurately on the Site, including ingredients, allergen information, and images. However, slight variations in color, size, shape, and appearance may occur between batches due to the handmade, artisan nature of our products. Such variations are not defects.
Each product listing on our Site includes a complete ingredient list and allergen declaration in accordance with FDA and FALCPA requirements, including the FASTER Act (sesame). The nine major allergens are: milk, eggs, wheat, soy, peanuts, tree nuts, fish, shellfish, and sesame.
Important: All MIGA products are produced in a residential kitchen that also processes wheat, milk, eggs, tree nuts (including but not limited to pistachios, almonds, hazelnuts, pecans, and Brazil nuts), soy, and sesame. Cross-contact with allergens is possible even in products that do not list a particular allergen as an ingredient.

MIGA is not liable for allergic reactions resulting from the consumption of our products, particularly where allergen information has been provided on the label and on the Site.
All products are subject to availability. We reserve the right to limit quantities, discontinue products, or modify our offerings at any time without prior notice. Seasonal and limited-edition items may not be available year-round.
Orders may be placed through our Site. By submitting an order, you are making an offer to purchase the selected products at the listed price. We reserve the right to accept or decline any order for any reason, including but not limited to product availability, pricing errors, or suspected fraud.
All prices are listed in U.S. dollars and are subject to change without notice. Prices do not include applicable sales tax, which will be calculated and added at checkout as required by Georgia law.
Payment is processed securely through Stripe at the time of order. We accept major credit cards, debit cards, and other payment methods supported by Stripe. Your order is not confirmed until payment has been successfully processed.
We do not store your full payment card details on our servers. All payment information is handled directly by Stripe in accordance with PCI DSS standards.
You will receive an order confirmation via email and/or SMS after your payment is processed. This confirmation constitutes our acceptance of your order.
MIGA offers tiered subscription plans that provide recurring deliveries of curated baked goods. Subscription details, including tier names, pricing, included items, and delivery frequency, are described on the Site.
Subscription fees are billed on a recurring basis according to the billing cycle described at the time of enrollment. By subscribing, you authorize MIGA to charge your payment method on file for each billing cycle.
You may cancel your subscription at any time through your account on the Site or by contacting us at (470) 684-2234 or hello@miga-atl.com. Cancellations take effect at the end of the current billing cycle. No refunds will be issued for the current billing period after a delivery has been dispatched or prepared.
We reserve the right to modify subscription offerings, pricing, and included items with reasonable advance notice. If a price increase occurs, you will be notified before your next billing cycle and given the option to cancel.
MIGA currently delivers within a limited area in Atlanta, Georgia. Delivery availability is displayed during checkout. We do not ship products outside the state of Georgia.
Orders are delivered to designated pickup points or directly as described on the Site. Delivery details, including estimated times and instructions, are communicated via SMS and/or email.
Once a product has been delivered to the designated location and delivery confirmation has been provided (including photo confirmation where applicable), the risk of loss or damage transfers to you. MIGA is not responsible for products left unattended after delivery, exposure to weather, or theft.
If you are unable to receive a delivery, please contact us as soon as possible. We will make reasonable efforts to accommodate rescheduling, but we cannot guarantee replacements or refunds for missed deliveries that were confirmed as completed.
Due to the perishable nature of our products, we generally do not accept returns. All sales are final.
If you receive a product that is damaged, defective, or materially different from what was described, please contact us within 24 hours of delivery at (470) 684-2234 or hello@miga-atl.com with a description and photo of the issue. We will assess the situation and, at our sole discretion, offer a replacement, store credit, or refund.
We do not offer refunds based on personal taste, flavor preference, or texture expectations. Our products are handmade and artisan in nature. If you are trying a product for the first time, we encourage you to start with a smaller quantity.
All content on the Site — including but not limited to text, images, photographs, logos, brand names, product names, recipes, graphics, and design — is the property of MIGA or its content suppliers and is protected by applicable intellectual property laws.
You may view and download content from the Site for your personal, non-commercial use only. You may not reproduce, distribute, modify, create derivative works from, publicly display, or otherwise exploit any content from the Site without our prior written consent.
“MIGA,” “Flor & Miga,” and associated logos and brand elements are trademarks of MIGA. You may not use these marks without our prior written permission.
You may be required to create an account to place orders or manage subscriptions. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account.
You agree to provide accurate, current, and complete information during registration and to update your information as needed.
We reserve the right to suspend or terminate your account at any time if we reasonably believe you have violated these Terms or engaged in fraudulent or harmful activity.

Our products and the Site are provided “as is” and “as available” without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
While we strive to produce high-quality artisan products, we do not warrant that our products will meet your specific expectations, dietary needs, or health requirements.
MIGA products are produced in a residential kitchen exempt from state inspection. By purchasing our products, you assume the associated risks.
To the fullest extent permitted by Georgia law, MIGA, its owner, and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Site, purchase of products, or consumption of products, including but not limited to damages for loss of profits, data, or other intangible losses.
Our total liability for any claim arising from or related to these Terms or our products shall not exceed the total amount you paid to MIGA for the specific product or order giving rise to the claim.
You agree to indemnify, defend, and hold harmless MIGA, its owner, and its affiliates from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to your violation of these Terms, your use of the Site, or your consumption of our products in a manner inconsistent with provided allergen and ingredient information.
These Terms are governed by and construed in accordance with the laws of the State of Georgia, without regard to conflict of law principles.
Any dispute arising out of or relating to these Terms or our products shall first be resolved through good-faith negotiation. If informal resolution is not possible, disputes shall be resolved through binding arbitration administered in Fulton County, Georgia, in accordance with the rules of the American Arbitration Association. Each party shall bear its own costs.
You agree to waive any right to participate in a class action lawsuit or class-wide arbitration against MIGA.
By providing your phone number and email address, you consent to receive transactional communications from MIGA, including order confirmations, delivery updates, and account notifications sent via SMS (through Twilio) and email.
Our Site may contain links to third-party websites or services. We are not responsible for the content, privacy practices, or terms of any third-party sites. Your use of third-party services is at your own risk and subject to those parties’ terms and conditions.
MIGA shall not be liable for any failure or delay in performing its obligations under these Terms if such failure or delay results from circumstances beyond our reasonable control, including but not limited to natural disasters, severe weather, pandemics, supply chain disruptions, utility failures, government actions, or labor disputes.
If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect.
These Terms, together with our Privacy Policy, constitute the entire agreement between you and MIGA regarding your use of the Site and purchase of products, and supersede all prior agreements, understandings, and communications, whether written or oral.
We may update these Terms from time to time. When we do, we will revise the “Last Updated” date at the top of this page. Material changes will be communicated through a prominent notice on the Site or by direct communication. Your continued use of the Site or purchase of products after changes are posted constitutes your acceptance of the revised Terms.
